An Arizona woman is planning to sue the city of Chandler after police illegally entered her home and arrested her while she was naked. The horrific incident was captured on cell phone video by both Esmeralda Rossi and her daughter, who was present.

Rossi was never charged with any crime, and an internal investigation into Officer Doug Rose’s actions found that he and another officer entered Rossi’s home without probable cause. They didn’t document arresting or un-arresting Rossi or the fact that she was naked. Investigators also found no video from Rose’s body camera from the incident.

Despite that, Rose was allowed to retire during the investigation with no charges brought against him.

The incident started when Rose and the other officer arrived at Rossi’s home after receiving a call about an argument between her and her ex-husband. Rossi was in the shower and wrapped herself in a towel after he daughter told her there were two officers at the door.

Rossi told ABC 15 that Rose was acting aggressively and that she felt unsafe around the officer, so she told them to wait at the door while she went to get a cell phone: “I closed the door. I turn to go into my living room, and I probably get about five steps in; and all of a sudden, I just hear boots running in after me, telling me stop or I’ll arrest you.”

It was then that both Rossi and her daughter started recording the interaction. Rossi admits that she took an attitude with the officers after they entered her home, but her lawyer, Marc Victor, says that’s no excuse for the officers’ behavior.

“Any one of us would be upset if a police officer barged into our homes without permission,” Victor told ABC 15. “She had a right to be upset.”

As seen in the video, Rose begins to handcuff Rossi in her kitchen without stating any reason for her arrest, and she starts screaming as she struggles to keep her towel on her body. Her daughter is heard crying as one of the officers asks incredulously “You’re not wearing any clothes?”

Rose is later heard in the video lecturing an audibly distraught Rossi, telling her “When a cop shows up… you’re not the one in charge. I don’t care if this is your house.” Rose then reportedly made Rossi’s daughter remove her mother’s handcuffs.

“I felt helpless. I felt violated. And honestly, I felt molested,” Rossi says of the incident.

Officer Rose is currently collecting his full pension.
