Heather Phillips, 40, is charged with two counts of lewd and lascivious behavior/sexual activity with a child under 16.

Police were called after the 15-year-old victim reported to his parents that he had been in a sexual relationship with Phillips and that she told him she was pregnant, the report said.

The parents of the victim informed police they they wished to press charges.

The victim told police that he had been in a relationship with Phillips’ 12-year-old daughter.

According to the police report, Phillips would have private conversations with the victim in her bedroom on numerous occasions to talk about his relationship with her daughter after arguments the two would have.

Phillips told him that he should not break up with her daughter and that he was a “hot kid,” the report said. She then allegedly told him that “she had feelings for him.”

Phillips began messaging the teen using an app called ooVoo after he broke up with her daughter in June.

The two met at a park, where they allegedly had sex on a slide the report said.

He told police that he did not want to have sex with Phillips and that she forced him.

On a second occasion, Phillips drove to the boy’s home and asked him to get inside her car. She drove them to her house and went into her bedroom.

The teen told her that he did not want to have sex with her.


While in the room, she took out a pocket knife and laid in on the nightstand and told him “don’t run,” the report said.

She allegedly performed oral sex on him and they had unprotected sex seven times.

Police released these texts, which they say are between them posing as the boy and Phillips

Two weeks later, she contacted the victim to tell him that she was pregnant. He told police that he did not know what to do and told his parents of their sexual relationship.

In an attempt to contact Phillips and obtain an admission, police used the victim’s cellphone to send messages to her.

She acknowledged their sexual relationship and the pregnancy, police said. She said she was planning to have an abortion within the next two weeks. In the messages she asked that he not tell his parents.

Phillips was arrested at La Petite Academy, where she worked.

La Petite Academy released the following statement:

“Ms. Phillips is on a leave of absence during this investigation. The police have notified us that this matter is unrelated to the school. We will take appropriate action pending the outcome of the investigation and any legal proceedings. Each of our employees is expected to uphold certain standards of personal and professional conduct. We don’t tolerate any deviation from these standards. Our focus remains on providing a safe and nurturing learning environment for the children in our care. We take our responsibility as caregivers very seriously.”

During an interview with police, she said that she was not pregnant and that the messages were a joke. She later admitted to having sex with the teen one time, but stated that he wore a condom – but wasn’t sure if he put it on, the report said.

She was booked into the St. Lucie County Jail.
